Notice of Privacy Practices — MindWave Psychiatry

Effective date: October 3, 2026

THIS NOTICE DESCRIBES HOW HEALTH INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

Our commitment to your privacy

MindWave Psychiatry (“we,” “our,” “us”) — Amindeep Lail, M.D., A Professional Corporation d/b/ a MindWave Psychiatry — is committed to protecting the privacy of your health information. We are required by law to maintain the privacy of your protected health information (“PHI”), to provide you with this Notice of our legal duties and privacy practices, and to notify you if there is a breach of your unsecured PHI.

How we may use and disclose your health information

We may use and disclose your PHI for the following purposes without your written authorization:

For treatment. We may use and disclose your PHI to provide, coordinate, or manage your health care — for example, to confer with other providers involved in your care, or to refer you to another provider.

For payment. We may use and disclose your PHI to bill and collect payment for services — for example, to verify your insurance coverage, submit claims to your health plan, or respond to billing inquiries.

For health care operations. We may use and disclose your PHI for our practice operations — for example, for quality assessment, staff training, licensing, and business planning.

As required or permitted by law. We may also use or disclose your PHI without your authorization when required or permitted by law, including for the following purposes:

  • As required by law (for example, to comply with a court order or subpoena);
  • Public health activities (for example, to report communicable diseases or adverse events);
  • Abuse, neglect, or domestic violence reporting as required by law;
  • Health oversight activities (for example, audits or licensure reviews);
  • Judicial and administrative proceedings (for example, in response to a court order);
  • Law enforcement purposes as permitted by law;
  • Coroners, medical examiners, and funeral directors as permitted by law;
  • Organ and tissue donation;
  • Research, under limited circumstances with required approvals or with de-identified information;
  • To avert a serious threat to health or safety — for example, if we believe disclosure is necessary to prevent serious harm to you or others, consistent with our legal and ethical duties (including duties to warn or protect);
  • Workers’ compensation as authorized by law; and
  • Military, veterans, and national security activities as permitted by law.

Emergencies. We may use or disclose your PHI in an emergency treatment situation as permitted by law.

Psychotherapy notes

“Psychotherapy notes” — notes recorded by a mental health professional documenting the contents of a counseling session, kept separate from the rest of your medical record — receive special protection under HIPAA. We will not use or disclose your psychotherapy notes without your written authorization, except in limited circumstances permitted by law (for example, to avert a serious threat to health or safety, or as required by law).

Uses and disclosures that require your written authorization

Other uses and disclosures of your PHI not described in this Notice will be made only with your written authorization. Specifically, we will obtain your authorization before:

  • Using or disclosing your PHI for marketing purposes;
  • Selling your PHI; or
  • Using or disclosing your psychotherapy notes as described above.

You may revoke an authorization in writing at any time, except to the extent we have already acted in reliance on it.

Your rights regarding your health information

You have the following rights with respect to your PHI:

Right to inspect and copy. You have the right to inspect and obtain a copy of the PHI we maintain about you, with limited exceptions. We may charge a reasonable, cost-based fee for copies.

Right to amend. If you believe the PHI we maintain about you is incorrect or incomplete, you may ask us to amend it. We may deny your request in certain circumstances, but we will explain why in writing.

Right to an accounting of disclosures. You have the right to request a list of certain disclosures of your PHI we have made, for up to six years prior to your request.

Right to request restrictions. You have the right to ask us to restrict how we use or disclose your PHI for treatment, payment, or health care operations. We are not required to agree to your request, except that we must agree to restrict disclosures to your health plan for services you have paid for in full out of pocket, as required by law.

Right to request confidential communications. You have the right to ask that we communicate with you about your health matters in a certain way or at a certain location (for example, by mail to a different address). We will accommodate reasonable requests.

Right to a paper copy of this Notice. You have the right to obtain a paper copy of this Notice at any time, even if you received it electronically.

Right to be notified of a breach. You have the right to be notified if there is a breach of your unsecured PHI.

To exercise any of these rights, please contact our Privacy Officer at the address below.

Our duties

We are required by law to maintain the privacy of your PHI, provide you with this Notice, abide by its terms, and notify you promptly if a breach occurs that may have compromised the privacy or security of your information. We reserve the right to change this Notice at any time; the revised Notice will apply to all PHI we maintain, and a current copy will be available at our offices and upon request.
